1. Agreement and Eligibility

These terms apply when you use ScoreQwik at https://scoreqwik.com. By using the service, you agree to these terms and our Privacy Policy. If you are not legally able to agree on your own, a parent or guardian must agree for you.

2. The Service

ScoreQwik provides language assessment and practice tools, automated writing and speaking evaluation, educational feedback, and, where offered, human review. Feature descriptions and availability may change as we maintain and improve the product.

3. Accounts

You must provide accurate account information and keep your login details secure. You are responsible for activity under your account and should tell us promptly if you suspect unauthorized access.

4. Your Content

You retain ownership of writing, audio, prompts, and other material you submit. You must have the right to submit that material and should not include personal or confidential information that is unnecessary for the evaluation.

You grant us a limited, non-exclusive license to host, copy, process, transmit, and transform your content only as needed to operate, secure, support, and improve the service and produce the feedback you request. This includes processing by contracted service providers and AI systems.

For submissions made while these terms are in effect, this license also allows us to create deidentified, aggregate statistics and research. We may publish aggregate findings, but the license does not allow us to publish your identifiable or raw submission, audio, transcript, or an identifiable excerpt without your explicit permission. Earlier submissions remain subject to the terms and notices that applied when they were collected.

5. Automated Feedback

Scores and feedback generated by the service are automated practice estimates. They may contain errors and are not official exam results, admissions advice, or a guarantee of exam performance. ScoreQwik is an independent practice service and is not endorsed by or affiliated with the organizations that own or administer the exams supported by the service.

6. Acceptable Use

Do not use the service to break the law, infringe another person's rights, distribute malicious code, interfere with the service, bypass usage limits, access another person's account, scrape the service at scale, or submit material you do not have permission to use. We may restrict or suspend access where reasonably necessary to protect users or the service.

7. Paid Services

Prices, billing periods, included usage, renewal terms, and any cancellation options are shown at checkout or in your account. Payments may be processed by a third-party payment provider. Refunds are handled according to the offer shown at purchase and any mandatory rights under applicable consumer law. Contact us if a charge appears incorrect.

8. Our Content and Software

We and our licensors retain rights in the service, software, design, branding, evaluation formats, and content we provide. These terms do not transfer those rights to you. You may use the service for its intended personal or educational purpose, subject to these terms.

9. Availability and Termination

We may change, suspend, or discontinue features and may suspend or terminate accounts that materially breach these terms. Where practical, we will give notice of significant changes or account action. You may stop using the service at any time and may request account deletion as described in the Privacy Policy.

10. Disclaimers

The service is provided on an "as available" basis. To the extent permitted by law, we do not promise that it will be uninterrupted, error-free, or suitable for every purpose. Nothing in these terms limits rights or remedies that cannot legally be limited.

11. Liability

To the extent permitted by law, we are not responsible for indirect or consequential losses arising from use of the service. Any limitation applies only to the extent allowed in your jurisdiction and does not exclude liability that cannot legally be excluded.

12. Changes to These Terms

We may update these terms as the service changes. We will post the revised version here, update the date above, and provide any additional notice required by law. Material changes apply from their stated effective date.
